The following ordinance governs the loan of collections for inclusion in exhibitions at other institutions:
- Article 1 – The collection of the MP-USP (Public Prosecutor's Office of the University of São Paulo) is registered by the National Institute of Historical and Artistic Heritage (IPHAN), and is subject to the provisions of Decree-Law No. 25, of November 30, 1937, with no restriction on the movement of goods, provided that good conservation, packaging, transport and storage are ensured, as well as the previously established return deadline, except in the cases provided for in article 14 of the aforementioned Decree-Law;
- Article 2 – The temporary loan of inventory items can cover a period from 24 hours to six months;
Sole paragraph: the loan of units for a period longer than six months will be subject to an Agreement, in accordance with Resolution 4715, of 10/22/1999, published in the Official Gazette on 10/27/1999, following the formal procedure through the higher instances of the Rectorate.
- Article 3 The interested institution must officially request the loan from the MP-USP Directorate, including the following information:
I – a list of the desired collection units, with their respective identification codes;
II – the desired loan period;
III – the exhibition project, indicating the location, media, technical equipment, and safety and environmental conditions;
IV – a written commitment that the collection units will have adequate lighting and environmental conditions, as determined by the MP-USP specialists;
V – the insurance must cover transportation to and from the location and the period of exposure (“nail by nail”), in the amount corresponding to the assessment provided by the MP-USP;
VI – the current insurance policy must be sent before the removal of the inventory units;
VII – awareness of the content of this Ordinance and its full acceptance, without reservations.
- Article 4 Loan requests, accompanied by the documentation required in Article 3, must be submitted to the MP-USP Directorate at least three months before the expected date the collection is to leave the institution.
Sole paragraph: In exceptional cases of loan requests submitted outside the deadline established in Article 4, the Deliberative Council may issue a written statement authorizing the loan.
- Article 5 – Loan requests will be analyzed regarding their relevance, availability, and the state of conservation of the requested collection items. Internal documentation – opinions and reports – will be forwarded for consideration and approval by the Deliberative Council/MP, in accordance with Resolution No. 4393, of May 8, 1997, Article 5, item XX.
- Article 6 – If the request is approved, the applicant institution will receive the following information regarding the collection items in question: dimensions and insurance value, conditions for exhibition – lighting, security, display method and environment – as well as recommendations on packaging and transport. If the requested items require restoration, the MP-USP will provide a cost estimate for the work.
- Article 7 – Packaging, transport, insurance, courier service, any necessary prior inspection of the exhibition space, and any restoration work that may be required will be paid for by the requesting institution. In the latter case, the requesting institution may indicate the restoration company, which must be approved and its work supervised by MP-USP.
- Article 8 – The MP-USP (Museum of Public Works of the University of São Paulo) will not accept companies to obtain quotes from transport companies, which is the sole responsibility of the requesting institution. However, if the contracted company acts in a way that compromises the physical integrity of the borrowed units, the MP-USP employee overseeing the work may suspend the activity until the appropriate procedures are followed.
- Article 9 – The schedule for picking up and returning collection items will be established by mutual agreement between the MP-USP and the requesting institution;
Sole paragraph: The Conservation Service will designate the employee from the Technical-Scientific Division of Collection and Curatorship of the MP-USP who will oversee the packaging, transportation, assembly of the exhibition, and also the disassembly and return, especially verifying the state of conservation, in order to prepare the return reports.
- Article 10 – Credits to MP-USP must be included in the texts and captions of the exhibition, catalogs, promotional materials, as well as other cultural products related to the event.
§ 1: The citations must follow the guidelines provided by MP-USP, including the use of the logo;
§ 2: Failure to comply with this article will result in the removal of the units and their return to the MP-USP, with the costs of the entire operation borne by the requesting institution.
- Article 11 – The renewal of loan of collection items may be granted if the relevant request is submitted to the Management at least thirty (30) days before the end of the commitment.
Sole paragraph: a reassessment and inspection of the collection units will be mandatory for loan renewals to be considered.
- Article 12 – In exchange for the loan and renewal, the MP-USP may charge fees, which must be paid to the Research Fund:
§ 1: The fee per unit of collection will be one minimum wage in effect in the State;
§ 2: The funds must be deposited prior to the date set for the collection of the items.
- Article 13 – During the course of the exhibition, the Public Prosecutor's Office of the University of São Paulo (MP-USP) may inspect the exhibition site and, if any irregularities are found, the collection items will be removed, after formal notification to the responsible institution, with their return being expedited.
- Article 14 – In the case of a traveling exhibition and/or one with geographical stages, the travel itinerary must be attached to the request, and the MP-USP may request the requesting institution to cover the costs of travel and per diem so that the MP-USP can accompany each stage of dismantling and reassembly.
- Article 15 This Ordinance shall enter into force on the date of its publication, and any provisions to the contrary are hereby revoked.
